These Terms and conditions govern the use of the services provided by Doneet.com. By using the website, users agree to these Terms , all applicable laws and all conditions or policies referenced here. Doneet may modify these terms of service at any time by posting a revised version on the website. Access to or continued use of the Services provided by Doneet after the effective date of the revised Terms constitutes your acceptance of the revisions.
The following definitions apply for the current terms and conditions of Service:
1) The Services: The services provided by Doneet.com
2) Campaign Owners: Those raising funds or starting a fundraising campaign.
3) Campaigns.: The fundraisers started by Campaign Owners
4) Donors: Those contributing to campaigns
5) Donations: Payments or donations made to the campaigns
6) The terms: The current terms and conditions of service
Doneet is an online platform for creating fundraising campaigns and receiving donations. Doneet makes no representations about the quality, safety, morality or legality of any Campaign, or donation or the truth or accuracy of the information posted by Campaign Owners. Doneet makes no guarantees that Campaign Owners will use donations as described in the Campaigns. Donors and Campaign Owners use the services at their own risk.
Users under 18 years of age are not eligible to use the services of Doneet without the consent of a parent or legal guardian. Users suspended from using the Services are not eligible to use the Services. Doneet reserves the right to refuse or suspend the use of the Service to anyone and to reject, cancel, interrupt, remove or suspend any Campaign, donation, or the Services at any time for any reason without liability.
Doneet is a place for kindness and charity. It is strictly forbidden to post any content that promotes hatred, discrimination, or spam. Avoid using the services to promote violence, degradation or hatred against individuals or groups. Also, do not post pornographic images or videos, or post links to sites that contain sexually explicit or violent material . We reserve the right at our own discretion to remove Campaigns and cancel User Accounts that violate these guidelines.
Campaign Owners are not permitted to create Campaigns to raise funds for illegal activities, promote hate, discrimination, inflict harm on people, animals or property, or to scam and abuse others.
Users must comply with all applicable laws and regulations in connection with their Campaigns, including the adequate use of donations. Campaign Owners shall not make any false or misleading statements with regards to their Campaigns.
Disputes between Campaign Owners and Donors
Doneet is under no obligation to become involved in disputes between Campaign Owners and Donors, or users and any third party. In the event of a dispute, we may provide the Campaign Owner's contact information to the Contributor so that the two parties may resolve their disagreement.
All information submitted in connection with a User account must be accurate and truthful. Users agree to provide additional details or documentation in case Doneet considers that a user account is operating with false information.
About Campaign Owners
Campaign Owners will respond truthfully to all questions posed to them by Doneet or by any Contributor. Campaign Owners are responsible for collecting and remitting any taxes on donations.
Contributors are solely responsible for investigating Campaign Owners and Fundraisers to the extent they feel is necessary before making a donation. All donations are made voluntarily and at the sole discretion and risk of the Contributor. Doneet does not guarantee that donations will be used as promised, that Campaign Owners will deliver on any other promises, or that a Campaign will achieve its target.
Doneet does not endorse, guarantee, make representations, or provide warranties about the quality, safety, morality or legality of any Campaign, or the truth or accuracy of User Content. Contributors are solely responsible for determining how to treat their donations for tax purposes.
Setting up an account on Doneet is free. Doneet will charge Service fees to Campaign Owners as a portion of the donations they raise. By using the Services, the users agree to a 5% service fee. Changes to Service Fees are effective after we post a notice of the changes on the Services. Updated Service Fees are applied to Campaigns launched after the notice is posted.
Doneet is not responsible for any refunds to campaign contributions. If a Campaign Owner is unable to perform on any promise to its Donors, or a Donor decides that his contribution should be refunded for any reason, the Campaign Owner will work with the Contributors to reach a mutually satisfactory resolution, which may include the refund of donations by the Campaign Owner.
Each Campaign Owner is responsible for complying with applicable tax regulations. Doneet can provide information about campaign donations to the relevant authorities if requested.
While using the Services, Users may post photos, videos, text, or other audio-visual materials. Users grant Doneet a royalty-free, worldwide license to use user content at its own discretion. Each User represents and warrants that its User Content and our use of such will not infringe any third party's intellectual property rights, or otherwise violate applicable law.
Third-Party Websites and other linked Sites
The Services may contain links to third-party websites, advertisers, or services that are not owned or controlled by us. Access to or use of third-party sites or services are at each User's own risk. We are not responsible for any loss or damage of any sort relating to User dealings with third-party sites or services.
Campaigner Owners and Contributors acknowledge and agree to comply with Our Payment Supplier's terms of service and its relevant policies. In all cases, third party processing fees apply in addition to any service fees. We are not responsible for the performance of any third party credit card processing or third party payment services.
Each User agrees to defend, indemnify and hold harmless Doneet, its subsidiaries and affiliated companies, and their officers, directors, employees, contractors and agents from and against any and all claims, causes of action, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorneys' fees and costs) and all amounts paid in settlement arising from or relating to use of the Services, breach of these Terms or violation of any laws.
Doneet has no fiduciary duty to any User. The services are provided on an "as is" and "as available" basis without any warranties, express or implied, including, without limitation, implied warranties of merchantability or fitness for a particular purpose, noninfringement or course of performance. Use of the services is at user's own risk.
Limitation of Liability
DONEET MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE MERCHANTABILITY OF THIS SERVICE OR FITNESS FOR ANY PURPOSE. YOU AGREE THAT YOU ARE RELEASING DONEET , ITS EMPLYEES AND AFFILIATED COMPANIES FROM ANY LIABILITY THAT WE MAY OTHERWISE HAVE TO YOU IN RELATION TO OR ARISING FROM THIS AGREEMENT, FOR REASONS INCLUDING, BUT NOT LIMITED TO, FAILURE OF OUR SERVICE, NEGLIGENCE, OR ANY OTHER TORT. TO THE EXTENT THAT APPLICABLE LAW RESTRICTS THIS RELEASE OF LIABILITY, YOU AGREE THAT WE ARE ONLY LIABLE TO YOU FOR THE MINIMUM AMOUNT OF DAMAGES THAT THE LAW RESTRICTS OUR LIABILITY TO, IF SUCH A MINIMUM EXISTS.
YOU AGREE THAT WE ARE NOT RESPONSIBLE IN ANY WAY FOR OFFERS, PROMOTIONS OR GUARANTEES MADE BY THIRD PARTIES THROUGH OUR PLATFORM. THIS INCLUDES ANY FAILURE TO DELIVER ANY GOODS OR SERVICES TO MEET YOUR EXPECTATIONS. WE ARE NOT RESPONSIBLE FOR ANY THIRD PARTY CHARITABLE OFFERS THAT MAY TURN OUT TO BE FRAUDULENT, IRRESPONSIBLE, OR OTHERWISE ADVERTISED IN BAD FAITH.
WE ARE NOT RESPONSIBLE FOR ANY FAILURES ON THE PART OF OUR THIRD PARTY PAYMENT PROCESSORS. WE ARE NOT LIABLE FOR ANY FAILURE OF THE GOODS OR SERVICES OF OUR COMPANY OR A THIRD PARTY, INCLUDING ANY FAILURES OR DISRUPTIONS, UNTIMELY DELIVERY, SCHEDULED OR UNSCHEDULED, INTENTIONAL OR UNINTENTIONAL, ON OUR WEBSITE WHICH PREVENT ACCESS TO OUR WEBSITE TEMPORARILY OR PERMANENTLY.
THE PROVISION OF OUR SERVICE TO YOU IS CONTINGENT ON YOUR AGREEMENT WITH THIS AND ALL OTHER SECTIONS OF THIS AGREEMENT.
For jurisdictions that do not allow Doneet to limit its liability: Notwithstanding any provision of the Terms, for Users in a jurisdiction that has provisions specific to waiver or liability that conflict with the foregoing, then Doneet's liability is limited to the smallest extent possible by law.
Termination of user accounts
Termination may result in the forfeiture and destruction of all information associated with any User Account. Users may terminate their User Account by following the instructions on the Services, but Doneet may retain the User Account information after termination in accordance with regulatory, accounting, and legal compliance procedures. All provisions of the Terms that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Each User agrees that any and all disputes or claims shall be resolved exclusively through final and binding arbitration.
Doneet only provides a platform to allow Campaign Owners to connect with Contributors. Users who access or use the Services do so at their own volition and are entirely responsible for compliance with applicable law.
Doneet makes no representations, warranties or other assertions as to the potential tax deductible status of any donation by a Contributor to a charitable cause or to a Campaign whose purported recipient is a recognized charitable institution. The listing of an organization via Doneet does not necessarily mean that the organization has been deemed— or remains currently deemed—a charitable or tax-advantaged organization.
Cooperation with Authorities
Doneet will cooperate with law enforcement authorities as required by law. We will cooperate with law enforcement agencies in any investigation of alleged illegal activity regarding the use of the Services when requested.
Users agree Doneet will provide notifications to such User via email, written or hard copy notice, or through conspicuous posting of such notice on our website. Users may opt out of certain means of notification or to receive certain notifications.
These Terms are the entire agreement between each User and Doneet regarding its subject matter. If any provision of these Terms are deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. Doneet's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.
Changes to Terms
Doneet may alter the Terms at any time. If a change is made, Doneet may notify Users in the Services, by email, by means of a notice on the Services, or other places we think appropriate.
